WAIVER OF LIABILITY FOR USE OF POOL and Hot Tub The guests agree to use extreme caution and care in the pool on the premises and to pay any and all repair charges for damage to the pool and/or property caused by the guests. Guests further agree that everyone using the pool will shower and clean feet upon use. Furthermore, the agreement is made that NO oils, bubble bath, soaps, other liquids, or any other harmful materials will be used in the pool. No glass products whatsoever are allowed in or around the pool. If any items such as soaps, bath products, food, alcohol, etc. are found in the pool, the guest will be charged a cleaning fee of $500. Guests acknowledge and accept the risks inherent in the use of the pool. Guests voluntarily assume the risk of injury, accident, death, personal injury, or property damage that may arise from the use of the pool. By using the pool guests agree to follow all house rules associated with it and release the host/property owner from any and all claims, liability, or losses whatsoever arising out of or in any way associated with the guests' use of the pool, including but not limited to death, personal injury, or property damage, regardless of whether injuries are caused by negligence.
Vehicles The maximum number of vehicles that may be located at a residence between the hours of 11:00 p.m. to 9:00 a.m. shall be limited to one (1) vehicle per approved bedroom or one (1) vehicle for every two and one-half (2½) people allowed under the maximum overnight occupancy.
MOKE VEHICLE RENTAL AGREEMENT Cobble & Key Property Group This Agreement governs the rental and use of the Moke low-speed electric vehicle (the “Vehicle”) coordinated by Cobble & Key Property Group on behalf of the Vehicle owner. Please read carefully. By signing this Agreement, you acknowledge and agree to the terms outlined herein. 1. Definitions "Agreement" refers to all terms and conditions contained herein. "You" and "your" refer to the individual signing this Agreement and any Authorized Driver. "We", "our", or "us" refer to Cobble & Key Property Group. "Authorized Driver" means the person signing this Agreement and any person listed by us on this Agreement who is at least 21 years old and possesses a valid driver’s license. "Vehicle" refers to the Moke provided, including all its accessories, tools, tires, documents, and keys. "Physical Damage" means damage caused by collision or upset and excludes damage from theft, vandalism, acts of nature, or internal wear. "Loss of use" means the inability to rent the Vehicle due to damage, calculated at the daily rental rate. 2. Rental, Indemnity, and Warranties This Agreement constitutes a contract for the temporary use of the Vehicle. We reserve the right to repossess the Vehicle at your expense if abandoned, used in violation of law, or used contrary to this Agreement. You agree to indemnify, defend, and hold harmless Cobble & Key Property Group and the Vehicle owner from all claims, liability, and costs arising from your use of the Vehicle. We make no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. 3. Condition and Return of Vehicle You must return the Vehicle in the same condition you received it, excluding normal wear. Returns after hours remain your responsibility until inspected. You must receive our approval for any servicing or repairs. You are responsible for maintaining fluid levels during use. 4. Responsibility for Damage or Loss; Reporting to Police You are responsible for all damage to or loss of the Vehicle arising from your actions, negligence, or breach of this Agreement. This includes costs for repair or replacement, loss of use, diminished value, and administrative expenses. All incidents must be reported to us and local law enforcement immediately. 5. Prohibited Uses and Breach You agree not to use the Vehicle: - Under the influence of alcohol or drugs - By anyone not an Authorized Driver - For unlawful or commercial purposes - On unpaved roads, beaches, dunes, or overloaded - In races, to tow or push objects, or transport more people than seat belts allow - With tampered odometers or low fluids Use of the Vehicle under prohibited circumstances is a breach of this Agreement and voids any coverage. 6. Insurance You are responsible for maintaining auto liability, collision, and comprehensive insurance covering your use of the Vehicle. 7. Charges You agree to pay all charges related to: - Additional drivers, optional services, fuel discrepancies - Violations, towing, impound, court fees - Collection costs including legal fees and late payment charges - Cleaning fees if the Vehicle is returned excessively dirty 8. Deposit Your deposit may be used to cover unpaid charges, damage, or violations under this Agreement. 9. Personal Property You release us from all liability for loss or damage to personal property left in or on the Vehicle, in any service vehicle, or in our offices. 10. Modifications This Agreement may not be modified except in writing and signed by us. Requests to extend rentals must be approved and documented in writing. 11. Miscellaneous No waiver by us of any breach constitutes a waiver of any other breach. You release us from liability for consequential or punitive damages. If any part of this Agreement is found invalid, the remainder remains enforceable.
