[ - ] Trampoline Policy (Strictly Off-Limits): The trampoline on the property is NOT an amenity and is strictly off-limits for guest use under any circumstances. Unauthorized access or use constitutes a material violation of house rules and may result in immediate reservation termination without a refund.

[ - ] Hot Tub Guidelines: Minors must be supervised by an adult at all times. No glass containers in or around the hot tub. Please replace and fasten the hot tub cover after each use.

[ - ] Property Safety: Exterior security devices are active on the premises for property monitoring.

LIABILITY WAIVER AND RELEASE AGREEMENT
WAIVER OF CLAIMS, INDEMNIFICATION, AND AMENITY RULES

Tenant/Guest hereby acknowledges and agrees that Tenant/Guest’s use of the Landlord’s property located at 90 Colonial Way, Falmouth, MA 02540, USA and the use of any permitted equipment and amenities, including but not limited to the hot tub, beach toys, beach chairs, grill, basketball hoop, fire pit, appliances, bicycles, and electric bicycles, involves inherent risks of injury to persons and property, and Tenant/Guest voluntarily assumes full responsibility for such risks, whether known or unknown.

Trampoline Notice: Tenant/Guest acknowledges that any trampoline on the property is strictly prohibited, off-limits, and not an amenity. Any unauthorized access or use of the trampoline by Tenant/Guest or Tenant/Guest's invitees is done in direct violation of house rules, and Tenant/Guest assumes full, sole liability for any injuries or damages resulting from such unauthorized use.

Hot Tub Conditions of Use:

[ - ] Age Requirement: Guests under the age of 18 are not permitted to use the hot tub without direct adult supervision. Do not use, or allow the hot tub to be used, alone.

[ - ] Health Precautions: Guests with health concerns, including but not limited to pregnancy, heart conditions, high/low blood pressure, or skin sensitivities, should consult a physician before using the hot tub.

[ - ] Safety & Rules: Guests agree to abide by all safety rules posted at the Property and to use the hot tub in a manner that does not endanger themselves or others. No glass containers near the hot tub area.

[ - ] Cover Maintenance: The hot tub cover must be securely replaced and fastened after each use to maintain water temperature, cleanliness, and safety.

[ - ] Duration & Substance Restrictions: Limit sessions to 15-minute intervals to avoid overheating. Alcoholic beverages and controlled substances should not be consumed before or during hot tub use.

Release of Liability and Indemnification:
In consideration of being permitted to lease the property and use permitted equipment and amenities for any purpose, Tenant/Guest hereby releases, waives, discharges, and holds harmless the Landlord, its members, officers, employees, and agents from all liability to Tenant/Guest and Tenant/Guest’s invitees, personal representatives, assigns, heirs, and next of kin for any loss, damage, or injury, including death or property damage, arising out of or related to Tenant/Guest’s occupancy of the property or use of permitted equipment and amenities, whether caused by the active or passive negligence of Landlord or otherwise, to the fullest extent permitted by the laws of the Commonwealth of Massachusetts.

Tenant/Guest further agrees to fully indemnify, defend, and hold Landlord harmless from any and all loss, liability, damage, or cost Landlord may incur arising from Tenant/Guest’s or Tenant/Guest's invitees' presence on the property or use of permitted equipment or amenities, whether caused by the negligence of Tenant/Guest or otherwise.

Tenant/Guest expressly agrees that this release, waiver, and indemnification provision is intended to be as broad and inclusive as permitted by Massachusetts law and that if any portion is held invalid, the remaining portions shall continue in full force and effect. Tenant/Guest acknowledges that no oral representations, statements, or inducements apart from this written agreement have been made.
